| 現在的註冊會址 (德輔道中280號,玻璃幕牆乙級寫字樓) 是我暫時借出,市值租金,管理費,中央冷氣及差餉等什費每月要六千多元,在過去三年每星期只有畫班使用兩小時,平均每月只使用十小時,現因有較大之活動室,所有活動都搬到新活動室進行,而註冊會址就一直完全空置,非常浪費,我想將一半分租出去,以減輕我的負擔,但現在的木門非常舊,如果更換玻璃門應可較容易租出,樓上樓下八成以上都係玻璃門,都無違法,為何我裝就違法,我只是想問有無會員或網友可提供一個較合理價錢!!! | 0001-Simon 7/7/2002 21:45:54 |  |
| Simon, Eagle, I don't know which section of the the Fire Prevention Ordinance you are in dispute, I wonder if you mind telling me the exact number so that I could have a browse of it on web. But when we are going to interpret a statute, we are not obliged to use the literal approach, which is following the literal meaning of that particular statue. We sometimes may have to look at the legislative intent of the statute, which is called the mischief rule or purposive approach. Law very often has two answers. I am not sure whether it is a criminal offence for installing glass without certificate, but it sounds like an offence of strict liability. | Simon, I do agree that some laws are outdated and should be reviewed. But what we should consider is the possible impact and consequences. I dont think if you really violate the law you mentioned about using more than 20 coins in one transaction will put you into trouble, as not so many people are as knowledgeable as you do. But the fact is, the Fire Prevention Ordinance are carried out by the government STRICTLY and SERIOUSLY, what is the point to put the club at risk and challenge the law enforcement just for the sake of good looking? | Simon, law is the law and rule is the rule. other peolpe ignored the law doesn't mean we should ignore it also. Just like so many people like open kitchen design in their home, in fact open kitchen violates the Fire Prevention Ordinance as well. There are live cases that some people ended up in courts and spent tens of thousands to correct their mistake.
